There are a number of visa classifications that permit a foreign national to work legally in the United States, including H, L, O and P visas. In addition to the basic documentation required of all visa applicants listed in our General Instructions, those seeking a visa for temporary employment in the United States should submit the following documents, if appropriate, at the time of the visa interview:
- Extensions approved by the Bureau of Citizenship and Immigration (BCIS), if any;
- Original DHS Notice (I-797), indicating approval of the petition;
- Photocopy of BCIS Notice of Action (I-797);
- Complete and updated curriculum vitae and list of publications;
- Transcripts from post-high school education; and
- Any other documents that may be deemed pertinent to the application.
Due to the thorough review of supporting paperwork that is required for temporary employment visas, applicants should be prepared to spend most of the morning at the consulate. Consulate staff will ensure that visa applicants are seen as quickly as possible. Applicants should also be aware of the possibility of the visa application requiring additional administrative processing, which will delay issuance of a visa.
